This document intends to inform our customers about European Union Directives concerning hazardous materials in products and provide information on ECRM's policy and efforts concerning these regulations.

The RoHS Regulations - the law in brief

European Union Directive 2002/95/EC, otherwise known as 'RoHS', restricts the use of six hazardous substances in certain electrical and electronic equipment (EEE). New products placed on the market in the European Union on or after July 1, 2006 cannot contain levels exceeding the following:

  • Lead, 0.1% by weight
  • Mercury, 0.1% by weight
  • Cadmium, 0.01% by weight
  • Hexavalent Chromium, 0.1% by weight
  • Polybrominated Biphenyls (PBB), 0.1% by weight
  • Polybrominated Diphenyl Ethers (PBDE), 0.1% by weight

'By weight' refers to any homogeneous material used in the product. If any portion of the material can be mechanically separated into different materials, each component must be considered separately. For example, if the product contains a painted metal part, the paint and the base metal must be considered separately when assessing the restricted materials.

These Regulations do not affect the application of existing legal requirements for EEE, including those regarding safety, the protection of health, existing transport requirements or provisions on hazardous waste. In other words, existing legislation on EEE and hazardous substances must also be complied with.

Scope of the Directive

The RoHS Directive identifies affected products by referring to another directive, 2002/96/EC on the waste from electrical and electronic equipment, known as WEEE. Categories 1, 2, 3, 4, 5, 6, 7, and 10 from Annex IA, are cited in RoHS:

    1. Large household appliances
    2. Small household appliances
    3. IT and telecommunications equipment
    4. Consumer equipment
    5. Lighting equipment, (including electric light bulbs and household luminaires)
    6. Electrical and electronic tools (with the exception of large-scale stationary industrial tools)
    7. Toys, leisure and sports equipment
    10. Automatic dispensers

RoHS does not apply to spare parts for the repair, or to the reuse, of electrical and electronic equipment put on the market before July 1, 2006

ECRM position towards the RoHS legislation

ECRM's products have been evaluated by a European Union Notified Body and found not to be within the scope of Directive 2002/95/EC (RoHS) or Directive 2002/96/EC (WEEE), making them exempt from this legislation.

    Statements of exemption are available at the offices of all authorized ECRM resellers.

However, notwithstanding the fact that ECRM is not subject to the RoHS requirements, we are working on banning the 6 substances, as part of ECRM's environmental policy to contribute to environmental protection and sustainable development.
